Terms and conditions
§ 1 Scope
These General Terms and Conditions (“Terms”) of MobiHero GmbH, Braunstr. 7, 81545 München (“Seller”) apply to all contracts concluded by a consumer or business customer (“Customer”) with the Seller through the KRONHERR Gastro online shop.
The version in force when the contract is concluded applies. Deviating terms of the Customer are not recognised unless the Seller expressly agrees to them in writing.
§ 2 Conclusion of contract
The presentation of products in the online shop is not a legally binding offer but an invitation to place an order. Clicking “Buy” submits a binding order for the goods in your cart. Receipt of the order is confirmed immediately by email; this does not yet constitute acceptance. The contract is concluded only upon dispatch confirmation.
§ 3 Prices and shipping costs
Prices displayed for private customers are final prices including statutory VAT. Selecting the business-customer view displays net prices plus statutory VAT. Checkout shows the applicable taxes and total amount payable.
Standard shipping within Germany and the other member states of the European Union is free. Where offered at checkout, express shipping within Germany costs EUR 9.99 including VAT. Freight items, such as drinks fridges, scrubber dryers and pallet trucks, are delivered to the kerb. We currently do not deliver to countries outside the European Union.
§ 4 Delivery
Goods are delivered from our Bremen warehouse to the delivery address provided by the Customer. In-stock goods generally dispatch within 1 to 2 business days. Parcel delivery takes 1 to 3 business days within Germany and 2 to 10 business days within the rest of the EU. Freight is delivered to the kerb by appointment arranged by telephone or electronically; delivery within Germany generally takes 3 to 7 business days.
§ 5 Payment
The payment methods displayed during the order process are available. The purchase price is due immediately upon ordering. Business customers may order on invoice with 14-day payment terms after approval.
§ 6 Retention of title
The delivered goods remain the Seller's property until paid in full.
§ 7 Statutory rights for defects and warranty
Statutory rights for defective goods apply. We additionally provide a 24-month manufacturer's warranty on all products from our own brands KRONHERR, LastWerk, Freeze., AirReactor, Portal. and Roastly. § 8 Liability
The Seller has unlimited liability for intent and gross negligence. For slight negligence, the Seller is liable only for breaches of essential contractual obligations and only for foreseeable damage typical of the contract. These limitations do not apply to damage resulting from injury to life, body or health.
§ 9 Withdrawal and returns
Consumers have a 30-day right of withdrawal. We cover parcel return costs within the European Union. For freight items, we arrange collection; the consumer bears the return cost, estimated at a maximum of EUR 149.00. Businesses within the meaning of section 14 of the German Civil Code (BGB) have no right of withdrawal; business returns are by arrangement. § 10 Data protection
Information on collecting and processing personal data is available in our privacy policy.
§ 11 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protections of the consumer's country of habitual residence remain unaffected. To the extent permitted by law, the place of jurisdiction is Munich.
